Brooklyn Grid LLC ("Brooklyn Grid," "we," "us," or "our") operates the website www.brooklyngrid.com and related online services, forms, accounts, and payment features (together, the "Services"). This Privacy Policy explains what personal information we collect, how we use and share it, how we protect it, and the choices you have.
We are located in New York City, and this Policy is written to comply with the laws of the State of New York and the City of New York that apply to our business, including the New York Stop Hacks and Improve Electronic Data Security Act (the "SHIELD Act," N.Y. Gen. Bus. Law §§ 899-aa and 899-bb), the New York Child Data Protection Act (N.Y. Gen. Bus. Law Art. 39-F), New York's Social Security number protection law (N.Y. Gen. Bus. Law § 399-ddd), New York's records-disposal law (N.Y. Gen. Bus. Law § 399-h), and the New York City Biometric Identifier Information Law (N.Y.C. Admin. Code §§ 22-1201 to 22-1205), as well as applicable federal laws such as the Children's Online Privacy Protection Act (COPPA) and the CAN-SPAM Act.
By using the Services, you acknowledge that you have read this Policy. If you do not agree with it, please do not use the Services.
1. Information We Collect
Information you give us directly

Contact and identity information: your name, email address, mailing address, and telephone number when you fill out a contact form, request a quote, subscribe to updates, or otherwise write to us.

Account information: your username, password (stored in hashed form), profile details, and communication preferences when you create an account.

Transaction and payment information: billing name and address, the products or services you purchase, and payment details. Full payment card numbers are collected and processed directly by our third-party payment processor (see Section 6) and are not stored on our systems.

Communications: the content of messages, support requests, reviews, or feedback you send us.
Information collected automatically

Device and usage data: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, links clicked, and the dates and times of your visits.

Cookies and similar technologies: as described in Section 4, we and our analytics and advertising partners use cookies, pixels, and similar tools to recognize your browser and understand how the Services are used.

Approximate location: general location inferred from your IP address. We do not collect precise GPS location without your permission.
Information from other sources

Service providers and partners: confirmation of payment from our payment processor, delivery status from shipping or scheduling vendors, and analytics from measurement providers.

Public sources and business partners: publicly available business contact information, and information from referral partners where you have asked them to connect you with us.
Sensitive information
In limited situations we may collect information that New York law treats as especially sensitive. We collect sensitive information only when it is necessary for a specific purpose you have requested, and we handle it as described in Sections 7, 12, 13, and 14:

Financial information, such as bank account details for invoicing or refunds, or credit-related information you provide in connection with an application or financing request.

Government identifiers, such as a Social Security number or driver's license number, only where required for identity verification, tax reporting, credit or background screening, or where the law requires it.

Health-related information you choose to share with us (for example, an accessibility accommodation request).

Biometric identifier information, if you use an optional feature or visit a physical location where such technology is in use (see Section 12).
2. How We Use Your Information
We use personal information for the following purposes:

To provide the Services, including creating and managing your account, responding to inquiries, processing orders and payments, and delivering the products or services you request.

To communicate with you about your account, transactions, service changes, security alerts, and customer support.

To send marketing communications, such as newsletters and promotional offers, where permitted by law. You can opt out at any time (see Section 10).

To operate, maintain, analyze, and improve the Services, including understanding which features are used and troubleshooting technical problems.

To personalize your experience and, where you have not opted out, to measure and deliver advertising for our own services.

To protect the security and integrity of the Services, detect and prevent fraud, abuse, and unauthorized access, and enforce our terms.

To comply with legal obligations, including tax, accounting, record-keeping, and data-breach notification requirements under New York and federal law, and to respond to lawful requests from public authorities.

For any other purpose that we describe to you at the time we collect the information, or with your consent.
We do not use sensitive information for advertising or profiling, and we do not use it for any purpose other than the one for which you provided it, unless you separately consent or the law requires it.
3. Legal Basis and Minors' Consent
For most users we process personal information because it is necessary to provide the Services you request, because you have consented, or because we have a legitimate business need that does not override your interests.
If we have actual knowledge that a user is between 13 and 17 years old, the New York Child Data Protection Act requires us to process that user's personal information only where it is strictly necessary to provide the requested service or for another purpose permitted by that law, unless we have obtained informed consent. We do not sell the personal information of any user we know to be under 18, and we do not use it for targeted advertising. See Section 11 for more about minors.
4. Cookies, Analytics, and Advertising Technologies
Cookies are small text files placed on your device. We use the following categories:

Strictly necessary cookies: required for the Services to function, such as keeping you logged in, remembering items in a cart, and protecting against fraud. These cannot be switched off in our tools.

Analytics cookies: help us understand how visitors use the Services. We use analytics providers such as Google Analytics, which collect information such as pages visited, time on site, and approximate location. Where our analytics tools offer the option, we configure them to truncate IP addresses and limit data sharing with the provider.

Advertising cookies and pixels: placed by advertising partners (for example, Meta and Google advertising pixels) to measure the effectiveness of our advertising and to show you ads for our services on other sites. These partners may combine this information with data they hold about you from other sources.

Functional cookies: remember your preferences, such as language or region.
Your cookie choices

Browser settings: most browsers let you refuse or delete cookies. Blocking strictly necessary cookies may prevent parts of the Services from working.

Cookie banner: where we display a cookie consent banner, you can accept or reject non-essential cookies and change your choice at any time via the "Cookie Settings" link in the footer.

Opt-outs for advertising: you can opt out of interest-based advertising from participating companies at optout.aboutads.info (Digital Advertising Alliance) and optout.networkadvertising.org (Network Advertising Initiative). For Google Analytics, you can install the Google Analytics Opt-out Browser Add-on.

Global Privacy Control: we honor Global Privacy Control (GPC) browser signals as a request to opt out of the sharing of your personal information for targeted advertising, where we are able to detect them.

Do Not Track: because there is no common standard for browser "Do Not Track" signals, we do not currently respond to them, except as described for GPC above.
5. How We Share Information
We do not sell your personal information for money. We share personal information only in the following circumstances:

Service providers: companies that perform services on our behalf, such as web hosting, payment processing, email delivery, customer support, analytics, cloud storage, scheduling, and shipping. Our contracts require these providers to protect personal information, use it only to perform services for us, and, as required by the SHIELD Act, maintain reasonable safeguards.

Payment processors: see Section 6.

Advertising and analytics partners: as described in Section 4, and subject to your opt-out choices. Under some state laws this kind of disclosure may be considered a "sale" or "sharing" of personal information; you can opt out as described in Sections 4 and 10.

Professional advisers: lawyers, accountants, auditors, and insurers, under duties of confidentiality.

Legal and safety purposes: to comply with a subpoena, court order, or other legal process; to respond to a lawful request from a government authority; to enforce our terms; or to protect the rights, property, or safety of our business, our customers, or others.

Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, subject to this Policy or an equivalent level of protection.

With your consent or at your direction.
We never sell, lease, trade, share in exchange for anything of value, or otherwise profit from the transaction of biometric identifier information, as prohibited by the New York City Biometric Identifier Information Law. We do not disclose Social Security numbers to third parties except as permitted by N.Y. Gen. Bus. Law § 399-ddd.
6. Payments
Payments made through the Services are processed by a third-party payment processor (the "Payment Processor"). When you make a payment, your payment card or bank account details are transmitted directly to the Payment Processor, which is certified under the Payment Card Industry Data Security Standard (PCI DSS). We receive only limited information, such as the last four digits of your card, the card type, the transaction amount, and a confirmation of payment. The Payment Processor's handling of your information is governed by its own privacy policy, which is linked from our checkout page.
If you provide bank account information directly to us for invoicing, ACH payment, or refunds, we treat that information as private information under the SHIELD Act, restrict access to it, encrypt it in storage and in transit, and retain it only as long as needed for the transaction and for our tax and accounting records.
7. How We Protect Your Information
As required by the SHIELD Act, we maintain a data security program with reasonable administrative, technical, and physical safeguards that is appropriate to the size and complexity of our business and the sensitivity of the information we hold. These safeguards include:

Administrative: designating an employee responsible for our security program, identifying reasonably foreseeable internal and external risks, training employees on security practices, selecting service providers capable of maintaining appropriate safeguards and requiring those safeguards by contract, and adjusting the program as business circumstances change.

Technical: assessing risks in our network, software, and information processing; encrypting private information in transit and at rest; using multi-factor authentication for administrative access; detecting, preventing, and responding to attacks and system failures; and regularly testing and monitoring the effectiveness of key controls.

Physical: assessing risks of information storage and disposal; detecting and preventing unauthorized access to physical records; protecting against unauthorized access during collection, transportation, and destruction; and disposing of private information within a reasonable time after it is no longer needed.
No method of transmission over the internet or of electronic storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for notifying us promptly if you suspect unauthorized use of your account.
8. Data Breach Notification
If we discover or are notified of a breach of the security of our systems that affects the private information of New York residents (such as a Social Security number, driver's license number, account or card number together with an access code, biometric information, medical or health insurance information, or a username or email address in combination with a password or security question), we will notify affected individuals in the most expedient time possible and without unreasonable delay, and in any event within thirty (30) days after discovery of the breach, as required by N.Y. Gen. Bus. Law § 899-aa, except where a delay is requested by law enforcement. We will also notify the New York Attorney General, the New York Department of State, the New York State Police, and, where applicable, the New York Department of Financial Services and consumer reporting agencies, as the law requires.
Notice will be provided by email, written notice, or telephone, or by substitute notice (including a conspicuous posting on the Services and notice to major statewide media) where permitted, and will describe what happened, the categories of information involved, the contact information for us and for relevant state and federal agencies, and steps you can take to protect yourself.
9. Data Retention and Disposal
We keep personal information only as long as necessary for the purposes described in this Policy, including to provide the Services, satisfy legal, tax, accounting, and reporting obligations, resolve disputes, and enforce our agreements. As a general guide:

Contact form and inquiry data: up to two (2) years after our last interaction with you.

Account data: for as long as your account is active, and for up to one (1) year after closure unless a longer period is required by law.

Transaction and billing records: seven (7) years, consistent with tax and accounting requirements.

Sensitive information (government identifiers, financial account details, health information, biometric information): only for as long as the specific purpose requires, after which it is deleted or destroyed.

Analytics and log data: up to twenty-six (26) months, after which it is deleted or aggregated so that it no longer identifies you.
When we dispose of records that contain personal identifying information, we do so in accordance with N.Y. Gen. Bus. Law § 399-h by shredding, erasing, or otherwise modifying the records so that the information is unreadable and cannot be reconstructed.
10. Your Choices and Rights
Regardless of where you live, we offer you the following choices:

Access and correction: you can review and update most account information by logging in, or by contacting us. You may request a copy of the personal information we hold about you.

Deletion: you may ask us to delete your personal information. We will honor your request unless we need to keep the information to complete a transaction, comply with a legal obligation, resolve disputes, or for another purpose permitted by law.

Marketing opt-out: you can unsubscribe from marketing emails by clicking the "unsubscribe" link in any message or by contacting us. We honor opt-out requests within ten (10) business days, as required by the CAN-SPAM Act. You may still receive transactional or service messages. To stop marketing text messages, reply STOP.

Cookies and advertising: see Section 4.

Opt out of targeted advertising and "sales": you may opt out of the disclosure of your personal information to advertising partners by using the "Cookie Settings" link on our website, by enabling Global Privacy Control in your browser, or by contacting us.

Limit use of sensitive information: you may ask us to use your sensitive information only for the purpose for which it was collected.
Residents of other states
If you live in a state with a comprehensive consumer privacy law (for example, California, Colorado, Connecticut, Virginia, or another state whose law applies to us), you may have additional rights, including the right to know, correct, delete, obtain a portable copy of, and opt out of certain processing of your personal information, and the right not to be discriminated against for exercising those rights. You may designate an authorized agent to make requests on your behalf. If we deny your request, you may appeal by contacting us using the information in Section 18.
How to make a request

We will need to verify your identity before acting on a request, which may require you to confirm information already on file. We aim to respond within forty-five (45) days and will tell you if we need more time.
11. Children and Minors
Children under 13
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verifiable parental consent as required by COPPA, we will delete it promptly. If you believe a child under 13 has provided us with personal information, please contact us.
Minors 13 to 17 (New York Child Data Protection Act)
If we have actual knowledge that a user is between 13 and 17, or if a feature of the Services is primarily directed to minors, we comply with the New York Child Data Protection Act. This means we:

process the minor's personal information only where strictly necessary to provide the service they requested, to conduct internal business operations, to protect security, to comply with law, or for another purpose permitted by the Act, unless the minor gives informed consent that is freely given, specific, and as easy to withdraw as to give;

do not sell the minor's personal information and do not use it for targeted advertising;

honor device- or browser-based signals indicating a user is a minor, to the extent recognized under Attorney General regulations; and
-
require our service providers to follow the same rules with respect to that information.
12. Biometric Identifier Information (New York City)
"Biometric identifier information" means a physiological or biological characteristic used to identify an individual, such as a retina or iris scan, fingerprint, voiceprint, or a scan of hand or face geometry.
We do not collect biometric identifier information through the Services as a condition of using them. If we ever offer an optional feature that relies on biometric identifier information (for example, a face- or fingerprint-based login), we will tell you before you enroll, use the information solely to verify your identity, store it in encrypted form, and permanently destroy it when the purpose for collection has been satisfied, when you close your account, or within one (1) year of your last interaction with us, whichever comes first.
At any commercial establishment we operate in New York City where biometric identifier information is collected, retained, converted, stored, or shared, we post a clear and conspicuous sign near each customer entrance, in plain and simple language and in the form prescribed by the New York City Department of Consumer and Worker Protection, disclosing that biometric identifier information is being collected.
In all cases, we never sell, lease, trade, share in exchange for anything of value, or otherwise profit from the transaction of biometric identifier information, as prohibited by N.Y.C. Admin. Code § 22-1202. Biometric identifier information is "private information" under the SHIELD Act and is protected as described in Sections 7 and 8.
13. Social Security Numbers
In compliance with N.Y. Gen. Bus. Law § 399-ddd, we will not: intentionally communicate your Social Security number to the general public; print it on any card or tag required to access our products or services; require you to transmit it over the internet unless the connection is secure or the number is encrypted; require you to use it to access a website unless a password or other authentication device is also required; print it on any material mailed to you unless required by law or as part of an application or enrollment process, in which case it will not be visible from the outside of the envelope; or encode it in a bar code, chip, magnetic strip, or similar technology. We limit employee access to Social Security numbers, safeguard their confidentiality, and do not require you to disclose your Social Security number as a condition of doing business with us unless the law requires it.
14. Health and Medical Information
We are not a covered entity under HIPAA, and health-related information you share with us is not protected health information under that law. If you choose to share health-related information with us (for example, to request an accommodation), we use it only for that purpose, restrict access to it, do not share it with advertising partners, and treat it as private information under the SHIELD Act. You are not required to provide health information to use the Services.
15. Third-Party Websites and Services
The Services may contain links to third-party websites, social media platforms, embedded content, or payment pages that we do not control. This Policy does not apply to those third parties, and we encourage you to read their privacy policies before providing them with any information.
16. Users Outside New York and the United States
The Services are operated from New York, United States, and are intended for users in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.
17. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the effective date at the top of this page and, if the changes are material, we will provide additional notice, such as by email or a prominent notice on the Services, before the changes take effect. Your continued use of the Services after the effective date of an updated Policy means that you accept the changes.

SMS Terms and Conditions
Effective date: September 14, 2026
These SMS Terms and Conditions ("SMS Terms") govern the text-messaging program operated by Brooklyn Grid LLC (the "Program"). By opting in to the Program you agree to these SMS Terms and to our Privacy Policy above.
1. Program Description
When you opt in, Brooklyn Grid LLC will send you text messages (SMS/MMS) to the mobile number you provide. Messages may include appointment and service confirmations and reminders, order and account notifications, customer-service responses, and, if you separately opt in, promotional offers and updates about our products and services.
2. How to Opt In and Consent
You can opt in by texting the keyword JOIN to 929-532-4552, by checking the SMS consent box on one of our web forms, or by providing your mobile number and agreeing to these SMS Terms at checkout. By opting in, you provide your express written consent to receive recurring automated text messages from Brooklyn Grid LLC at the number you provided, in accordance with the Telephone Consumer Protection Act (TCPA). Consent to receive marketing text messages is not a condition of purchasing any goods or services.
You confirm that you are the account holder or authorized user of the mobile number provided, that you are at least 18 years old, and that you will notify us immediately if the number is reassigned or you no longer have access to it.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
3. Message Frequency
Message frequency varies depending on your activity and preferences. You can expect up to four (4) messages per month for marketing messages, plus transactional messages triggered by your orders, appointments, or account activity.
4. Message and Data Rates
Message and data rates may apply. Standard messaging rates charged by your wireless carrier will apply to all messages sent and received. Please contact your carrier for details about your plan.
5. How to Opt Out
You can cancel the Program at any time by texting STOP to 929-532-4552. After you send STOP, we will send you one final confirmation message that you have been unsubscribed, and you will no longer receive messages from that Program. You may also unsubscribe by contacting us at office@brooklyngrid.com. If you have opted in to more than one Program, replying STOP will unsubscribe you from the Program that sent the message; you may text STOP ALL to unsubscribe from all of our text programs. To rejoin, opt in again as described in Section 2.
We honor opt-out requests promptly and, in any event, within ten (10) business days.

7. Supported Carriers
The Program is available on most major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, and others. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your carrier and may not be available in all areas.
8. Privacy
We collect and use your mobile number, opt-in date and time, the keyword or method you used to opt in, and your message history in accordance with our Privacy Policy above. We will not sell your mobile number or SMS opt-in consent to any third party, and we do not share mobile opt-in data with third parties for their own marketing purposes.
9. Changes and Termination
We may modify or cancel the Program or these SMS Terms at any time. Material changes will be communicated by text message or posted at www.brooklyngrid.com. Your continued participation after any change constitutes acceptance of the updated SMS Terms. We may suspend or terminate your participation if you violate these SMS Terms or applicable law.
